Terms of Use

The Our Health Our Community website (ourhealth) is operated by the Consumers Health Forum of Australia.

Access and use of ourhealth is subject to the Terms of Use contained in this document. CHF reserves the right to amend the Terms of Use at any time. Since your use of ourhealth is subject to these Terms, you should periodically refer to them.

Ourhealth provides opportunities for individuals to share ideas and comments through interactive forums such as a ‘Have a say’ discussion forum, polls and an ideas wall. Any opinions, advice, statements, views or other information expressed on these forums are solely provided by, and are the responsibility of, the person posting such communication and not of Consumers Health Forum of Australia (CHF) (unless CHF is specifically identified as the author of the communication).

1. Registration and Login Names

In order to share your ideas and comments on ourhealth or to use certain CHF services, you are required to establish an ourhealth user account with CHF. To establish an ourhealth user account you are required to submit your email address, city, state and post code. It is also optional to provide additional information which may enhance your experience on ourhealth and improve communication with CHF such as your name, gender, age, community networks, health interest and experiences. You can update this information at any time via your ourhealth user profile, created when you establish a user account.

CHF generally recommends that applicants register a pen name or pseudonym as their online ourhealth user name (not their real name). You should be aware that the comments you post on ourhealth can remain online indefinitely and may be found through search engines or online archives. Users must not impersonate another person.

CHF may block registration of users whose suggested login names are considered inappropriate.

Registration of an ourhealth user account is restricted to users who disclose their age as 18 years or older.

CHF will not accept any registration that CHF suspects are being made by or on behalf of a member who has been suspended for repeated violation of these conditions of use.

2. Passwords and Security

When you register an ourhealth user account, you register a password. You are responsible for maintaining the confidentiality and security of your password. You may change your password via your ourhealth user profile at any time.

Accordingly, you understand and agree that you are fully responsible for all actions and submissions made from your account.

If you become aware of any unauthorised use of your account, you should notify CHF immediately.

3. Termination of Account

You can close your ourhealth user account at any time by unsubscribing or by notifying CHF. You should note, however, that the contributions you made while you were a registered ourhealth user, may still be available on ourhealth after your account has been closed.

If CHF reasonably believes you have breached these Terms of Use, CHF reserves the right to restrict access to or terminate your account, with or without notice, and without any liability to you.

4. Discussion Rules

When contributing your views using ourhealth, you will ensure that you:

1.Protect your personal privacy and that of others by not including confidential information or personal information about yourself or another forum participant. This includes identifying an individual by their real name or providing personal contact information, email address, Facebook or other online social network name, phone number, place of work/school etc.

2. Post comments and material to the forum that are directly relevant to the vision and objectives of the site: namely, improving Australian healthcare by joining a consumer conversation that aims to share the views, ideas and experiences of health consumers to support consumer advocacy.

3.Do not post or link to any inappropriate, offensive or illegal material.  Inappropriate content is anything that may offend or is not relevant to the discussion.

4. Represent your own views and do not impersonate or falsely represent any other person.

5.Do not post anything that could be considered intolerant of a person’s race, culture, descent, national origin, religion, ethnicity, appearance, gender, sexual preference, religion, age or disability.

6.Do not post anything which racially or religiously vilifies others.

7.Do not use any foul language, harass, threaten, defame, intimidate or embarrass any person or organisation or government. Disguising swear words by deliberately misspelling them does not make them any less offensive. A discussion post comment is defamatory if it lowers or harms the reputation of a person or organisation.

8. Do not post any advertising material or unsolicited material (spamming).

9.Do not post material to the forum that infringes the intellectual property rights of others.

10.Do not promote commercial or personal professional interests in your posts on ourhealth.

11.Do not post any medical or legal advice, including recommendations that people change or stop their medications or treatment.

12.Do not incite, encourage or make reference to conduct that may constitute a criminal offence or violate Australian law.

13. You are  legally responsible for the content you submit to ourhealth.

14. Publishing of any material on ourhealth is at the sole discretion of CHF.

6. Copyright

When you submit comments or content, in any format, you acknowledge that you have all necessary rights, including copyright, in the material that you are contributing to ourhealth.p>

You acknowledge that all contributions to ourhealth can be archived and republished to be used by the CHF for any purpose.

7. Disclaimer

Views and recommendations of third parties, which may be included on ourhealth, do not necessarily reflect the views of CHF, or indicate a commitment to a particular course of action.

Links to other Internet sites are for your convenience. These links do not constitute endorsement of material at those sites, or any associated organisation, product or service.

CHF takes reasonable care in linking to other websites but has no direct control over the content presented in those websites or the availability of those the websites.

CHF does not endorse or recommend any links to external websites or third party content.

CHF makes no representation that the material on any linked websites does not infringe the intellectual property rights or any other rights of any person.

8. Privacy Statement

We will not to share your personal details, such as your email, with anybody else without your express permission.

9. Severability

If any of these terms and conditions or any provisions of these terms and conditions are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions, which will continue to be valid to the fullest extent permitted by law.

10. Indemnification

You agree to indemnify, defend and hold harmless the Consumers Health Forum and its employees, from and against all liabilities, losses, expenses, damages and costs, including reasonable legal fees, claims, demands and proceedings whatsoever, howsoever arising, resulting from or in connection with any violation by you of these Terms of Use, including, without limitation, the submission of any inaccurate or incorrect information.
